These Terms of Use ("Terms") govern your use of the Plant Help mobile application ("App") operated by Bytelink Technologies Pty Ltd (ABN 30 671 056 572) ("we", "us", "our"). By using the App, you agree to these Terms.
1. Description of Service
Plant Help uses artificial intelligence to analyse photos of plants and provide diagnostic suggestions and care recommendations. The App is intended as a helpful guide for home gardeners and is not a substitute for professional horticultural, agricultural, or arboricultural advice.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you should use the App with the involvement of a parent or guardian.
3. Subscriptions and Payments
- Free tier — Core features (photo diagnosis, fix plan, save diagnoses) are available at no cost.
- Plant Help Pro — Premium features (follow-up questions, PDF export) require an active subscription purchased through the Apple App Store or Google Play Store.
- Billing — Subscription payments are processed by Apple or Google, not directly by us. Pricing is displayed in the App before purchase.
- Auto-renewal — Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your device's App Store or Google Play subscription settings.
- Refunds — Refund requests are handled by Apple or Google in accordance with their respective refund policies.
4. User Content
You retain ownership of any photos you submit through the App. By submitting a photo, you grant us a limited, non-exclusive licence to process it through our AI service solely for the purpose of providing a plant diagnosis. Photos are processed in memory and are not stored on our servers after the diagnosis is returned.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code from the App
- Interfere with or disrupt the App's servers or infrastructure
- Submit content that is offensive, harmful, or violates the rights of others
- Use automated tools to access the App in a manner that exceeds reasonable use
6. Disclaimer of Warranties
The App and all diagnoses are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that:
- Diagnoses will be accurate, complete, or suitable for your specific situation
- The App will be uninterrupted, error-free, or free of harmful components
- Following the suggested fix plans will resolve your plant's condition
AI-generated advice may be incorrect. Always exercise your own judgement and consult a professional for valuable or sensitive plants.
7. Limitation of Liability
To the maximum extent permitted by law, Bytelink Technologies Pty Ltd and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damage to or loss of plants, crops, or property.
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law or other applicable law.
8. Intellectual Property
The App, its design, code, and content (excluding user-submitted photos) are owned by Bytelink Technologies Pty Ltd and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from the App without our written permission.
9. Termination
We reserve the right to suspend or terminate access to the App if you violate these Terms. You may stop using the App at any time. Termination does not affect your obligation to pay for any active subscription — cancel through your device's store settings.
10. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
